Nine more properties seek release from Van Alstyne's extraterritorial jurisdiction

The council acknowledges five new petitions Tuesday covering 157.8 acres. Since June 2024, owners have sought to pull 87 properties and about 3,410 acres out of the city's ETJ, the ordinance says.

Owners of nine more properties around Van Alstyne have asked to be taken out of the city's extraterritorial jurisdiction, and the City Council is set to formally acknowledge their petitions Tuesday, Oct. 13.

The ordinance is on the consent agenda for the 6:30 p.m. meeting at City Hall, 152 N. Main Drive. Its text says acknowledging receipt "in no way" amounts to approving the petitions.

What is in this batch

The draft ordinance lists five petitions covering nine properties and 157.802 acres, with an appraised value of $3,179,767 and a market value of $6,381,522. The agenda summary describes the item as "nine petitions," a count that matches the number of properties rather than the number of petitions in the ordinance.

The tracts listed include:

  • Two parcels on FM 3356 of 56.5 and 66.2 acres, the largest in the batch
  • A 6.49-acre tract at 15371 U.S. 75
  • A 5.15-acre tract on Highway 121
  • Three parcels along Durning Road totaling 13.57 acres
  • Two tracts listed at 13703 FM 121 totaling about 9.8 acres

A running total since 2024

This is the seventh ordinance of its kind the council has handled since June 2024, according to the recitals in the document. The largest came first: five petitions that month took 23 properties and 1,584.76 acres out of the ETJ. Later rounds followed in September 2024, January 2025, June 2025, October 2025 and May 2026, ranging from one petition to 10.

With Tuesday's ordinance, the city says it will have received petitions from 37 property owners covering 87 properties and 3,409.66 acres. Those properties carry a combined appraised value of $12,962,651 and a market value of $99,894,341, the ordinance states.

The ordinance cites the section of the Texas Local Government Code that allows residents of an ETJ to petition a city for release. Consent items are enacted with one motion unless a council member asks to discuss one separately, the agenda notes.

The same agenda carries proposed increases in fees for new water meters, bulk construction meters and meter tampering. The agenda item, labeled "NOT WATER RATES," says the cost of meters and parts has climbed substantially over the last year and the city needs to cover its costs. The posted packet does not list the proposed amounts.
